44-year-old Cleve Octave was told by Chief Magistrate Candia Carette-George that the only reason why she was not imposing a custodial sentence on him is that the convictions that he has before are regarded as “time spent” meaning they have passed the time limit.
Octave was arrested by the police after he entered the workplace of his child’s mother on October 18, 2022, beat her, and also wounded her in the process.
He pleaded guilty and in his plea in mitigation told the court that she was saying things about him. “You cannot beat a woman like that and in her workplace…I am sure that you are stronger than her,” she told him.
“When I hear a man raises his hand on a woman, I am not happy about that. You need to have self-control, woman is to be treated with dignity and respect, women are to be loved.”
She told him that he has pleaded guilty, not wasted the court’s time, his previous convictions are spent and she can see that he is “remorseful” and sorry for his actions.
Octave also told the court that he has lost his job and this further frustrated him.
He was fined $1,000.00 for the charge of wounding to be paid on or before January 31, 2023, in default (3) three months in jail. On the charge of battery on a female, she imposed no separate penalty.
“Go and take care of your children and stay out of trouble,” she warned him.
