ROSEAU, DOMINICA, March 9, 2026-The High Court in Dominica has struck out an appeal by the Prosecution in a matter of bail that was granted by a Magistrate to Dr. Theodore Thomas.
Dr. Thomas is charged with attempted murder and discharging a firearm less than 50 yards in a public place. The incident is said to have occurred on January 2, 2026.
After hearing from the defense and prosecution, Senior Magistrate Michael Laudat decided that Dr. Thomas was “not a flight risk” and granted bail for $75,000.00 with sureties, he was to surrender to the jurisdiction of the court, report to the Roseau police station every Monday and Friday from 7 am to 7 pm, surrender all his travel documents, not to interfere with the victim and or any witnesses and was forbidden from living the state without the permission of the court. He is to return to court on March 30, 2026.
However, the prosecution immediately served notice to the court that they had filed an appeal against the decision to grant bail, resulting in Dr. Thomas being further remanded at the Dominica State Prison.
Wayne Norde, lead counsel for Dr. Thomas, then petitioned the High Court challenging the appeal filed by the prosecution.
Speaking to Nature Isle News (NIN) in an exclusive interview, Norde had this to say, “The defense is very pleased today with the outcome of the bail matter at the High Court.”
He went on to explain that “Bail was previously granted by the Magistrates Court last week, and history was created when the prosecution immediately appealed the matter. However, we led an application at the High Court whereby we contested the appeal on the ground that there was “not proper service” and the Learned Judge agreed with us, and the appeal was deemed to be “disposed of” so the original decision of the Magistrate stood.”
“At this time, we will not be commenting on the evidence of the matter since it remains before the court. We ask the public and the media to respect the integrity of the proceedings and the rights of all the parties involved. Our client maintains his innocence and looks forward to the opportunity to fully answer the allegations in court at the appointed time. We respect the judicial process and will continue to engage the matter through proper legal channels as the case progresses.”
Norde expressed gratitude to counsel Noelize Knight-Dider, who conducted the application in the High Court and did the appeal on behalf of Dr. Thomas. Gina Abraham Thomas and Joshua Francis, who are also counsel on record in the matter.
That Doctor is entitled to bail in the high court. Once it is established that he is not a flight risk, he can get bail. The victim is alive. If a man is on remand for murder and his case is not call in a timely manner and he is on remand for a very long time, superior courts has ruled that such person should be bailed. That Law govern the entire caribbean. The prosecution can try to object to bail but they wouldn’t succeed
Just a thought? What about the kalinago police that blatantly shot the guy 3 times in his back @ the Roseau bayfront. Is that case sweet under the rug????
The man that killed 2 people and burnt them in scoots head fight for bail. The prosecution disrespected the Magistration decision out of conflict of interest. The Director of Prosection is in a relationship with the plaintiff father. Justice was served to grand Dr. Thomas bail and this is fair. It is a lesson learnt for him and others.
