Jefferson Casimir granted bail for charge of “Attempted Murder” by Chief Magistrate

A Salisbury man who was first denied bail on a charge of “attempted murder” has finally been able through his lawyer Wayne Marsh to convince the court to grant him bail.

Jefferson Casimir was charged with attempting to murder Sampson Langlais also of Salisbury.

Casimir’s attorney Wayne Marsh in a renewed bail application before Chief Magistrate Candia Carette-George argued that there is “no basis upon which his client should continue to be held on pretrial detention in circumstances where his client has no previous conviction, is not a flight risk and an asset to his community”.

Marsh further argued that the constitutional presumption of innocence and the right to liberty demands that all allegations no matter the severity are matters to be proven at trial and that a person’s liberty must not be denied merely based on “allegations”.

In response to the application by Marsh, the prosecution advised the court that although it maintains its position that the charge of “attempted murder” is very serious and that the weapon allegedly used to commit the offense has not been found it would “no longer object to bail but would leave the decision as to whether to grant bail to the court.”

In making its ruling the court noted that “the police have not been able to find the alleged weapon despite the passage of time and that it was not convinced that granting the prosecution more time to conduct its investigation would result in the discovery of the alleged weapon”.

The court, therefore, granted bail to Casimir in the sum of $75,000 with conditions that he report to the Salisbury Police Station once per week, that he refrain from physical contact with the virtual complainant, that he lead an industrious life, not re-offend while on bail, and that he informs the court of any intention to change his address.

The matter case has been adjourned until 11th December 2022.
