High Court Judge Colin Williams has released his Judgment in his decision to deny the application for the revocation of double murder accused Jonathan Lehrer.
In his decision, he stated that “the Application by the Chief of Police and the Director of Public Prosecutions for the revocation of bail granted to the Claimant/Respondent, Mr Jonathan Lehrer, fails. The application had no merit.”
He also labeled the Defendants/Applicants conduct “lacking justification and was
unreasonable and oppressive.”
There are weaknesses in the our prosecution of this case. All is not well. However, i find the Judge’s stance towards the Prosecution unsympathetic and at times hostile. The mere thought of allowing this dude the leeway to travel out of Dominica defies logic, considering his apparent wealth and connections away from our shores. The “flight risk” argument ought to have been sufficient to deny him bail. Like other men who live and work in Dominica with prostrate issues, he could be treated here for the same, even allow him to bring in his own medic.
This action by the judge just encourages people to go out and settle their difference by committing murder. It appears that the learned judge has already made up his mind in this matter. There seems to be a two tier justice system operating in Dominica with one benefitting the rich and notorious and the other working against the less fortunate. Unfortunately I sense a high level of arrogance in this judge, I hope I am wrong and he is just doing his work based solely on the law and that his denial for the revocation of bail has nothing to do with the statement by the Minister.
