Loubiere man fined three thousand dollars for possession and trafficking of cannabis

Delbert Philbert of Loubiere has until March 30, 2024, to complete a fine of three thousand dollars imposed on him by Magistrate Michael Laudat after he pleaded guilty to a charge of possession of cannabis and trafficking of cannabis.

The fine must be paid in two installments of $1,500.00 the first by 30, October 2023 in default 6 months in jail, and the second $1,500.00 by March 30, 2023and in default 6 months in jail.

Brief facts

Armed with a search warrant, on June 11, 2023, the police left on GA613 to the home of Delbert Philbert of Fond Baron, Loubiere to search for drugs. On arrival, he was met at the premises and the search warrant was read and shown to him. He was also asked to witness the search.

While searching one of the bedrooms, the police noticed a clear glass jar with clear zip-lock bags containing what appeared to be cannabis. Asked what he knew about it Philbert replied, “A little weed I have there for me to smoke.”  A further search in the washroom resulted in the finding of cannabis in a black plastic bag.

He was informed by the police, that the contents of the jar are more than 28 grams as allowed by law and so he was being arrested on suspicion of “possession of cannabis and possession with intent to supply.” In front of the defendant, at Police Headquarters, the jar was opened and counted totaling 56, and weighed 30 grams. The cannabis found in the washroom was weighed and totaled 140 grams.

Also arrested and charged was Lennisha Mitchel of Kingshill who was at the home of Philbert during the search. She pleaded “not guilty” and the prosecution withdraw the charges against her.

They were both represented by lawyer Wayne Norde in the matter. He begged the court not to impose a custodial sentence on his client stating that the cannabis was for medicinal purposes and that he was remorseful for his actions.
