State discontinues two matters

The State has informed the court that they have filed “discontinuance notices” in two matters and will be offering “no further evidence” in those cases.

The matters involve Kenvick Victor who was charged with possession of goods with duty which has not been paid and Andy Esprit who was charged with “causing the death of Kurt Matthew by dangerous driving.”

The matter involving Andy Esprit of Campbell happened on Sunday, November 26, 2017, on the EO Leblanc Highway in Canefield at around 9:15 pm.

According to the police, motor vehicle registration number HE213, driven by Andy Esprit of Campbell, was traveling in a northerly direction, and another vehicle, registration number TE348, which was parked on the western side of the road in the custody at that time of Kurt Matthew.

Esprit lost control of his vehicle which crashed into the other vehicle while Matthew was about to board it.

Matthew, then aged 48, sustained multiple injuries and was taken to the Accident and Emergency Department of the Princess Margaret Hospital where he received medical attention. However, hours later, he succumbed to his injuries and was pronounced dead by a medical doctor.

Director of Public Prosecutions (DPP) Sherma Dalrymple informed the court that although by law, she is “not required to give reason (s) for her decision based on the matter involving Esprit, “the evidence in the matter does not support the charge” and in the Victor matter. “The State falls short on the evidence for which the accused is charged.”

Both men are represented by lawyer Wayne Norde. They were both then discharged by presiding High Court Judge Colin Williams.
