Magistrate frowns at prosecution for not having photo exhibits

Magistrate Pearl Williams said she is “fed up” with excuses by the prosecution who claims that the machine used to produce photo prints at the Criminal Investigations Department (CID) is “not working.”

During a matter at the Magistrate’s court where the police photographed an item to be used in court as an exhibit, the prosecution told the court that they were not able to produce the photos of the items since the machine at CID was not working.

“It is not just today that I am hearing about that, it is now going on two years, this is evidence for the court, get it fixed, this is unacceptable, this is a court of law where justice has to be dispensed, where are the powers that are supposed to deal with that, tell them I say to get it fixed and the court is fed up with such excuses,” she said annoyed.

She stated that the prosecution is coming up with the same excuses in the court in Grand Bay and elsewhere and it is time to “fix this matter.” “It means that if someone pleads “not guilty” then the exhibits photographed will not be available and that matter will take a long time before being dealt with,” she said.
