Senior Magistrate Bernard Pacquette has dismissed a major drugs case for “want of prosecution” after the prosecution failed to adhere to make certain submissions as mandated by the court on time.
Anthony Jno Baptiste who was was arrested on December 30, 2015, by the police and charged with possession and possession with intent to supply 190,000 grams of cocaine with an estimated street value of EC$5,073,000.00.
After hearing submissions from Jno Baptiste’s lawyer Gina Dyer Munro and then Sergeant Davidson Cadette on behalf of the prosecution magistrate Bernard Pacquette granted bail in the sum of EC$500,000.
During the trial, when the exhibits were submitted and admitted into evidence, the signature of the presiding Magistrate should have been on the documents, but it was discovered that it was not, and, as a result, the defense made certain submissions not to have the exhibits entered into evidence.
That resulted in legal arguments as the prosecution contended that the error was one of the courts. The Magistrate then gave both sides a date to address him and make submissions on the matter and having not heard from the prosecution, the defense asked that the case be “dismissed for want of prosecution” which the Magistrate did.
The Office of the Director of Public Prosecutions (DPP) says they are reviewing the file.
