Court grants former UWP Senator on alleged incitement charge permission to travel

Former United Workers Party (UWP) Senator Dr. Thomson Fontaine who is facing a charge of alleged “incitement” has been granted a variation in his bail conditions so he can travel back to South Sudan where he has been employed.

Dr. Fontaine who returned to the island on August 3, 2022, was told by the court that he had breached two of his bail conditions. His lawyer Cara Shillingford Marsh told the court that her client’s flight back to Dominica was “canceled” and as a result, he was delayed in returning. She asked the court to grant bail on “the same terms and conditions as before” since her client was committed to seeing an end to the matter.

He was then granted bail to return to Dominica on November 30, 2022, and his matter was set for December 9, 2022. Dr. Fontaine was also granted permission to travel for work purposes to South Sudan from August 29, 2022, until December 1, 2022. During that time, his reporting conditions as part of his bail were also suspended.

On his return to Dominica, he is to return his travel documents (passport) to the court on December 6, 2022, and surrender himself to the court’s jurisdiction on that date. The prosecution did not object to the variation of his bail conditions.
